Kev’s Class UK LTD - Terms and Conditions
Disclaimer
Learners, staff and parents must follow a respective Code of Conduct. Additionally, all individuals must also follow all other school policies while attending any Kev's Class sessions. By either: completing an intake form, allowing your child to attend a class, attending a class yourself or being on the premises in which Kev's Class operates, you hereby agree to the below Terms and Conditions and accept that you will follow the Code of Conduct in place and any supporting policies. Kev's Class UK LTD nor any of its Directors, Staff or Volunteers accept any responsibility for the negligence of any party in following these policies and their principles. All policies are open the the public and can be requested at any time by email or phone. Staff are there only for the supervision of the activity to ensure it is carried out appropriately and safely. We recommend parents wait in designated areas during the class. Parents/Guardians are not permitted to stay in the classroom with their children. Kev’s Class UK LTD reserves the right to amend these Terms at any time by posting the amended terms on the Kev's Class website or by sending an update email. Continued membership or attendance following the posting of amended Terms constitutes your acceptance of the amendments. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
Time and Location Consent
Sessions will take place at your allotted session time in person at Kev's Class Centre
Kingsknowe or online. Locations can be subject to change but we will give you as much notice as possible if a change does occur and you will have the option to cancel this session with no penalty if locations change from your normal location. If you wish to change session location or time we will endeavour to do this within 2 weeks of your request subject to availability. If this is not possible we will give you alternative solutions. If no solution is available and you no longer wish to carry on with your normally planned sessions you will need to terminate your membership in line with our termination policy.
Tutoring and Session Resources and Facilitation
Tuition and other sessions will be facilitated by either a combination or one of our online learning platforms that include but are not limited to Phonics Hero and 3P Learning and paper-based resources as deemed fit by Kev’s Class team. We can also provide homework to be completed outwith sessions limited to 15 minutes of work per subject per child per session. Subjects tutored will be agreed during your trial session and could be any combination of English, Maths, Reading, Writing, or Handwriting. Other subjects or a different combination may be requested with 2 weeks prior notice. The tutor will be a member of the Kev's Class team and meet the expectations set out by Kev's Class UK LTD. We will endeavour to keep your tutor the same for each session but in case of holiday, sickness or staff leaving, your tutor may change but will still meet the expectations set out by Kev’s Class UK LTD.
Terms of Fees Payable to Kev's Class UK LTD
Invoices for session fees are sent out and due on the 1st of every month. These invoices are calendar-based invoicing for the month in advance meaning they dynamically take into account all of the sessions that would take place in that month and have reductions for any planned holidays or cancelled sessions during that period. Fees are calculated by a per session fee and therefore your monthly invoice may be different to the 4-week sample membership fee shown at your trial session. Fees are inclusive of VAT. Fees will be paid every month by way of either online payment, point-of-sale payment or in cash. Late invoice payments may be liable for a late payment fee of 10% per week. If a holiday or session cancellation request has been made after the Sunday previous to the invoice for that period has been generated, you will see a reduction on the invoice in the next period to take this into account as long as the request satisfies our cancellation policy. We reserve the right to change the fees or payment date but will give a minimum of 1 calendar month's notice ahead of a change.
Terms of Cancellation
In the event of a cancellation by The Student/Parent: If sessions are cancelled with 72 hours notice, you will not be charged for that session. This is limited to one free cancellation per invoicing period. If less notice is given you will be charged for that session and you will not be eligible for a rescheduled session. We reserve the right to use our judgment for cancellations with less notice given if it is due to sickness or a verifiable emergency.
For extended holidays over school term breaks where we are operating as normal such as Easter or Summer or other instances, we require 2 weeks notice for multiple session cancellations within a period. Terms of Freezing Tuition
Should you wish to freeze your membership a flat fee of £20 per session per member will be charged to hold your places. This will be added to normal invoice for that period.
Terms of Termination
Should you wish to cancel your membership with us, we require a minimum of 4 weeks' notice from your desired last session date. With this, you will still have sessions for 4 weeks after you give notice of termination and are liable to settle the invoice for that period. If less notice than this is given for termination, you will still be liable for 4 weeks' worth of planned sessions.
Kev’s Class UK LTD reserves the right to terminate the agreement at any time for cause, including but not limited to disruptive behaviour, non-payment of fees, or violation of these Terms. If Kev’s Class UK LTD terminates the agreement, a prorated refund will be issued depending on the number of sessions remaining in the pre-paid period.
Terms of Tutor Absence and Holiday
The Tutor reserves the right to take time off from the typical schedule. The Tutor will provide a minimum of 1 week's notice for extended Holiday periods and 24 hours' notice, where possible, in the event of emergency or sickness. We will endeavour to provide a cover tutor during this absence but any missed session due to Tutor Absence or Holiday that cannot be covered will be rescheduled or not charged.
We also operate closure periods throughout the year. You will receive 4 weeks written notice of closure periods where no sessions take place. You do not pay for sessions during this period and this will automatically be reflected in your invoice for that period.
Obligations of the Tutor
The Tutor agrees to carry out all necessary research prior to each lesson so as to maximise
the Student’s learning time. The Tutor agrees to keep all information regarding the Student’s education confidential within members of Kev’s Class team unless written permission has been granted by the Parent/Guardian to disclose or child protection or safeguarding concerns arise. This includes any work that the Student has produced during or outwith lesson times. The Tutor agrees to carry out all lessons in person unless otherwise agreed. The Tutor will be a member of the Kev's Class Team. The Tutor shall not complete homework or any other classroom assignments that are intended for completion by the Student.
Obligations of the Student
The Student agrees to attend all scheduled lessons and be proactive in making suggestions about their own education in collaboration with Parents/Guardians. The Student agrees to complete any homework or classwork assignments set by the Tutor in a timely manner as agreed prior to the task being set. The Student understands that it is not within the Tutor’s remit to complete homework or classroom exercises on behalf of the student and that the Tutor’s role is one of support. The Student agrees to treat members of staff, the building and property with respect.
Obligations of the Parent/Guardian
The Parent/Guardian agrees to pay the agreed fees in a timely manner.
The Parent/Guardian understands that tuition is a means of support and cannot guarantee
progress in any way. The Parent/Guardian understands that it is not within the Tutor’s remit to complete homework or classroom exercises on behalf of the student and that the Tutor’s role is one of support. The Parent/Guardian agrees to adhere to all the terms set within this agreement. The Parent/Guardian agrees to supervise all sessions and activity out with sessions with The Tutor. The Parent/Guardian consents to the Kev’s Class team interacting with The Student within and outwith sessions if he/she is not present to supervise directly. The Parent/Guardian is responsible for the costs of any damages caused by The Student.
Activity Provider Terms
Kev's Class UK LTD is an activity provider. It is at the sole discretion of the Parent/Legal
guardian to leave the grounds of any site where Kev's Class delivers classes while a child
attends for the duration, and should only do so under the trust and knowledge that their child
is competent enough to look after themself and attend toilet facilities on their own. Kev's Class team are PVG checked and will always ensure the health, safety and security of attendees at any classes but cannot provide personal care - this is the responsibility of the Parent/Legal Guardian. Staff are there only for the supervision of the activity to ensure it is carried out appropriately and safely. We recommend parents wait in designated areas during the class. Parents/Guardians are not permitted to stay in the classroom / session space with their children.
Online Sessions / In-Person Sessions - Safeguarding and Child Protection
Session completed online will be recorded and retained securely for the purposes of
safeguarding. Recordings will be held for a minimum of 5 years from the date of the session.
In line with child protection regulations, Kev's Class team reserves the right to share
information relevant to child protection concerns to the relevant local authority noted either in online or private sessions.
Photography/Marketing
Kev's Class may have your full and explicit consent to take photography or recorded
videography of either yourself or of your child if they are under 18 years of age. Your choice is confirmed on your intake form. You can update your choice by contacting us.
Photos and videos may be used for social media and/or marketing materials print or digital - you can update your choice by contacting us at hello@kevsclass.com.
Privacy
Kev's Class UK LTD collects, processes and holds certain pieces of personal data when
parents/individuals book on to our classes, create an enquiry or join our newsletter. We are a registered body with the ICO. Attendees/Parents/Guardians have the right to request that your information is corrected, changed or removed.
